YREKA — State of Jefferson Juris Coordinator Mark Baird appeared before the Siskiyou County Board of Supervisors and touted the supreme court experience of their “pro bono attorney” Eugene Martin, in his attempt to woo Siskiyou County into joining his federal lawsuit against California. Siskiyou County never joined Baird’s lawsuit.

Baird failed to mention that his “pro bono attorney’s” actual full name is Eugene Martin Lavergne. He left off the last name and gave only only the first and middle name.

Baird also misrepresented Eugene Martin Lavergne as an attorney, failing to mention that Lavergne had been disbarred by the Supreme Court of New Jersey and sentenced to seven years in prison for stealing $108,000 of his client’s money. He’s no longer an attorney. He is banned from being an attorney the rest of his life.

Lavergne was convicted of gross neglect, lack of diligence, knowing misappropriation of client trust funds, failure to return client files on termination of representation, lack of candor towards a tribunal, making false and misleading communications concerning a lawyer’s services, knowingly making false statements to disciplinary authorities, failure to cooperate with disciplinary authorities, conduct involving dishonesty, fraud, deceit or misrepresentation, amongst other changes.

Lavergne told Yreka News and Scott Valley News that the charges are “bulls–t.” He has been released from prison, pending an appeal, he said, and clarified that he is not an attorney, as Mark Baird led the supervisors to believe. Lavergne said that he is only “consulting” Baird in this lawsuit and considers himself the “most knowledgeable” in the nation on this subject.

While out of prison on appeal, Lavergne has filed his own federal lawsuit in Washington, D.C. district court seeking 6,230 congressional seats in the House of Representatives, using similar legal strategies as Baird is doing against California, in seeking to add 1,200 legislators to the state. Baird is currently raising money for Lavergne’s lawsuit from State of Jefferson supporters.

Additionally, Baird told the Siskiyou County Board of Supervisors that his non-profit 501(c)(4) corporate board voted to “indemnify” the county, in the event the lawsuit against California goes south and they are forced to pay the state’s legal fees.

As a reserve deputy for the Siskiyou County Sheriff’s Department, Baird’s ultimate bosses would be the supervisors.

The board questioned Baird on the “indemnification” concept, wanting him to give them proof that there are funds to “indemnify” the county, if the case were to lose.

Baird assured them that there are large donors waiting to make their donations until after the case was filed.

“Indemnify” is a legal term meaning “to guarantee against any loss which another might suffer. Example: two parties settle a dispute over a contract, and one of them may agree to pay any claims which may arise from the contract, holding the other harmless.” Typically this is done with a trust account or a bond issued, neither of which were offered.

Mark Baird became a reserve deputy for the sheriff and bought the local small radio stations for approximately $1 million in cash, to give himself credibility to lead his State of Jefferson movement when he launched it in Siskiyou County.
