New California had its first day in Court in their effort to overturn the election results from the 2020 general election. Following NCS initial filing on December 28, 2020 the new state had to over come the courts own incompetence when the filing was first made to get a shortened hearing. The courts admitted error cost NCS the opportunity to be heard before the January 6, 2021 vote of the Electoral College in Washington DC.

NCS claims all the mail in ballots cast during the 2020 general election should not have been cast nor counted due to missing statutory language on the ballots.

“The case was stalled by the court when we first filed in order to avoid any problems with the certification of Joe Biden as president” stated Paul Preston, President of New California State.

Yesterday’s hearing was a hearing to overcome the objections of the California Department of Justice who were demanding the case be thrown out. Robert E. Thomas III representing New California State argued on the merits of the case and several other points that the court had brought up in their pleadings.

The case was not struck down from the bench which was anticipated by the Department of Justice and will prevail until the judge in the case makes a ruling.
