Ninth Circuit Hears Argument in California National Guard Case



The Ninth Circuit U.S. Appeals Court heard oral argument in Newsom v. Trump, a case examining the legality of President Trump's deployment of National Guard troops to manage immigration-related protests in the L.A. area amid objections from Gov. Gavin Newsom (D-CA).


On June 12, U.S. District Court Judge Charles Breyer ruled that Trump's deployment of the troops violated the law, arguing the protests fell "far short of 'rebellion.'" The Trump administration immediately appealed, and the ruling was suspended, pending a decision by the Ninth Circuit.


Attorney Brett Shumate, representing the Trump administration, said, "Unfortunately, local authorities are either unable or unwilling to protect federal personnel and property from the mob violence ongoing in Los Angeles today," and that Trump therefore determined the protests were a rebellion. Attorney Sam Harbourt, representing Gov. Newsom, argued Trump exceeded his authority under federal law and unlawfully circumvented the governor.
