The President of the United States can utilize a number of Executive Orders and Acts of Law to suppress a rebellion or insurrection. Here are the main Acts and Orders relevant in todays national environment.

Acts

1807 Insurrection Act [§§?251 to 254b.Renumbered §§?240a to 240f]

International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (IEEPA)

National Emergencies Act (50 U.S.C. 1601 et seq.)

Section 301 of title 3, United States Code,

Executive Orders

On September 12, 2018 President Trump signed Executive Order 13848 and declared a national emergency pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) to deal with the unusual and extraordinary threat to the national security and foreign policy of the United States constituted by the threat of foreign interference in or undermining public confidence in United States elections. This EO is a major step toward the 1807 Insurrection Act being implemented by President Trump.

Then on September 10, 2020 the national emergency declared on September 12, 2018, was continued beyond September 12, 2020.  Therefore, in accordance with section 202(d) of the National Emergencies Act (50 U.S.C. 1622(d)), The President continued for 1 year the national emergency declared in Executive Order 13848 with respect to the threat of foreign interference in or undermining public confidence in United States elections.

Sedition

Sedition is overt conduct, such as speech and organisation, that tends toward rebellion against the established order. Sedition often includes subversion of a constitution and incitement of discontent toward, or rebellion against, established authority. Sedition may include any commotion, though not aimed at direct and open violence against the laws. Seditious words in writing are seditious libel. A seditionist is one who engages in or promotes the interest of sedition.

Treason

The betrayal of one’s own country by waging war against it or by consciously or purposely acting to aid its enemies.

The Treason Clause traces its roots back to an English statute enacted during the reign of Edward III (1327–1377). This statute prohibited levying war against the king, adhering to his enemies, or contemplating his death. Although this law defined treason to include disloyal and subversive thoughts, it effectively circumscribed the crime as it existed under the Common Law

During the thirteenth century, the crime of treason encompassed virtually every act contrary to the king’s will and became a political tool of the Crown. Building on the tradition begun by Edward III, the Founding Fathers carefully delineated the crime of treason in Article III of the U.S. Constitution, narrowly defining its elements and setting forth stringent evidentiary requirements.
